Welcome to Medola. These Terms and Conditions (“Terms”) govern your use of our mobile application and services, including doctor consultations, home visits, nurse bookings, pharmacy orders, and pathology test requests (collectively, the “Services”). By downloading, accessing, or using Medola, you agree to be bound by these Terms. Please read them carefully before using our Services. Use of the App and our Services is subject to these Terms. Please only use Medola if you agree to them. 

Definitions

  • “App” refers to the Medola mobile application and any associated platforms.
  • “User,” “you,” or “your” refers to any individual accessing or using our Services.
  • “Healthcare Professional” includes doctors, nurses, pharmacists, or laboratory technicians engaged through the App.
  • “We,” “our,” or “us” refers to Medola, its parent company, employees, and authorised partners.

Eligibility

You must be at least 18 years old to use Medola. By using our Services, you confirm that you meet this requirement and that the information you provide is accurate, complete, and truthful. If you are accessing the Services on behalf of another person (such as a dependent or elderly family member), you confirm that you have the authority to act on their behalf. 

Scope of Services

Medola provides a digital platform to:

  • Book doctor home visits and teleconsultations.
  • Obtain prescriptions issued by qualified healthcare professionals.
  • Share prescriptions with pharmacies within a defined radius to receive medicine quotations.
  • Approve preferred quotations and arrange medicine delivery.
  • Book nursing services.
  • Schedule diagnostic and pathology tests.

Medola itself is not a healthcare provider, pharmacy, or laboratory. All medical advice, diagnosis, treatment, prescriptions, and health services are delivered solely by independent, licensed healthcare professionals.

Medical Disclaimer

The Services provided through Medola are for facilitation purposes only. Medola does not offer medical advice, diagnosis, or treatment. All medical and health-related decisions must be made between you and the healthcare professional providing the consultation or service. 

You should not disregard or delay seeking professional medical advice based on information obtained through the App. In case of an emergency, please contact your local emergency services immediately. 

User Responsibilities

When using Medola, you agree to:

  • Provide accurate, complete, and up-to-date information.
  • Use the Services only for lawful purposes.
  • Maintain confidentiality of your account login details and not share them with others.
  • Ensure you are available at the agreed time and location for consultations, visits, deliveries, or tests.
  • Use prescriptions and medicines strictly as advised by the prescribing doctor.
  • Any misconduct towards healthcare professionals will not be tolerated
  • Please note our healthcare providers are running tight on appointment schedule, so it will be users responsibility to be available on time.
  • In any case if not able to attend the appointment within 10 minutes it will be rescheduled, and rescheduling charges will apply.
  • You must not misuse the App, submit fraudulent information, attempt unauthorised access, or engage in any activity that disrupts or harms the Services.

Fees and Payments

Certain Services may be chargeable. Payment must be made using the secure payment gateways integrated into the App. You agree to provide accurate billing details and authorise us or our payment partners to process payments. 

Prices displayed for medicines, tests, or services are indicative until confirmed by the relevant provider (doctor, pharmacy, or laboratory). Once you approve a quotation, the cost becomes binding. 

Medola does not control or set the prices quoted by independent pharmacies or laboratories. 

Cancellations and Refunds

Cancellation policies may vary depending on the service provider (doctor, nurse, pharmacy, or laboratory). Refund eligibility will be subject to the provider’s terms and any applicable laws. Medola will facilitate communication between you and the provider but is not responsible for disputes relating to refunds or cancellations. 

Third-Party Providers

Our Services rely on third-party providers, including doctors, pharmacies, laboratories, and delivery agents. While we take reasonable steps to verify their credentials and quality, Medola is not responsible for the acts, omissions, advice, or services provided by these third parties. 

Any disputes regarding prescriptions, medicines, or treatments must be resolved directly with the relevant provider. 

Data Protection

Your personal and medical data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms. By using Medola, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. 

Intellectual Property

All intellectual property rights in the App, including its design, software, logos, and content, are owned or licensed by Medola. You are granted a limited, non-transferable, and revocable licence to use the App solely for personal, non-commercial purposes. You must not reproduce, distribute, or modify any part of the App without our prior written consent. 

Limitation of Liability

To the maximum extent permitted by law:

  • Medola is not liable for the accuracy, reliability, or outcomes of medical consultations, prescriptions, or diagnostic services provided by third parties.
  • We are not responsible for delays, cancellations, or failures caused by healthcare professionals, pharmacies, laboratories, delivery agents, or unforeseen circumstances.
  • Medola is not liable for indirect, incidental, or consequential damages, including but not limited to loss of income, data, or business opportunities.


Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.

Indemnity

You agree to indemnify and hold harmless Medola, its employees, directors, and partners from any claims, liabilities, damages, or expenses (including legal fees) arising out of your misuse of the Services, breach of these Terms, or violation of applicable laws. 

Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you breach these Terms, misuse the Services, or engage in fraudulent or harmful behaviour. Upon termination, your right to use the Services will immediately cease, but your obligations regarding fees, liabilities, and indemnities will survive. 

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the court of India

Changes to these Terms

We may update these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. Updated Terms will be made available in the App and on our website, and continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
